1. Acceptance of Terms

Welcome to www.KeysRealEstateServices.com (the “Site”), operated by Keylani Ortiz doing business as Keys Real Estate Services (“we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Site. By using the Site, you represent and warrant that you meet these requirements.

3. Services Provided

Visiting the Site, submitting a form, requesting a tour, or otherwise communicating with us does not create an agency, brokerage, fiduciary, or attorney client relationship between you and Keys Real Estate Services. Any such relationship arises only after a written agreement, such as a Buyer Broker Agreement, Listing Agreement, or similar engagement document, has been signed by both parties.

5. Property Listings & Information Disclaimer

Property information displayed on the Site, including listings, photos, square footage, lot size, taxes, school assignments, HOA details, and similar data, is provided by third parties such as MLS feeds, sellers, and public records. This information is believed to be accurate but is not guaranteed. All information should be independently verified by the buyer or the buyer’s representative. Listings may be withdrawn, sold, or have their prices changed without notice.

Message and data rates may apply. You may opt out at any time by replying STOP. Reply HELP for assistance.

8. User Conduct

You agree not to:

  • Attempt to gain unauthorized access to any portion of the Site or related systems

  • Submit false, misleading, or fraudulent information through any form

  • Upload or transmit viruses, malware, or any other harmful code

  • Scrape, copy, or republish content from the Site without our prior written permission

  • Harass, abuse, threaten, or impersonate other users, our team, or any third party

9. Intellectual Property

All content on the Site, including text, graphics, logos, images, video, and software, is the property of Keys Real Estate Services or its licensors and is protected by copyright, trademark, and other intellectual property laws. 11. Limitation of Liability

To the fullest extent permitted by law, Keys Real Estate Services and its owners, employees, contractors, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site or our services. Our total cumulative liability for any claim related to the Site shall not exceed one hundred US dollars ($100.00).

12. Disclaimer of Warranties

The Site and all content are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non infringement, and accuracy of information.

13. Indemnification

You agree to indemnify, defend, and hold harmless Keys Real Estate Services and its owners, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

We reserve the right to suspend or terminate your access to the Site at any time, with or without notice, for any reason including violation of these Terms.

15. Governing Law & Venue

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or the Site shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona.

16. Changes to These Terms

We may update these Terms at any time by posting a revised version on the Site and updating the Effective Date. Your continued use of the Site after any change constitutes your acceptance of the revised Terms.

17. Severability

If any provision of these Terms is held to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Keys Real Estate Services regarding your use of the Site, and supersede all prior agreements and understandings.
